Well, they’re here for a reason. Considering some Touhou characters have extremely fearsome powers, I think the fact spellcard rules are here prevents from a major apocalypse to happen or for someone to kill everybody and goodbye. Taking the picture, Yamame is a good example here. Being a spider Youkai whose ability is to spread diseases, she could as well give you a lethal one and kill you near-instantly without any feelings or remorses. Another example would be Flandre. Having the power to crush everything and anything, she could -well- take Gensokyo’s eye and destroy it…
There are a ton of examples I could give about characters who have an outrageously powerful ability and could rule over Gensokyo if they used it for nasty means without any rules set.
Quoting the spell card rules as written in Perfect Memento in Strict Sense, it states “Do not use meaningless attacks.” Which clearly gives us an explanation that if there wasn’t any form of regulation such as those rules, everybody would fight in a chaotic pattern and Gensokyo would soon turn into Utsuho’s former dream, a Hell above ground.

A spell card battle is not a matter of strength, last. It is a matter of spirit, and beauty. Spellcards aren’t exactly used to… Destroy, nor they are used to defeat. They’re used more as a… Showoff? Yes. This is probably a correct albeit crude term, but this kind of sums up the whole basis of a spellcard. Technically, the more “spiritual” you are, the more your chances are of winning. Which can explain why most last bosses are characters with a very advanced maturity, spirit and knowledge (Remilia, Eirin, Shikieiki, Kanako, Byakuren…)
In fact, without any spellcard rules, I doubt Gensokyo would still “exist”.
It probably wouldn’t!
Duel between youkai are cause for fear that the small land of Gensokyo may collapse.
However, if youkai are unable to fight, their power will gradually vanish.
Therefore, I propose the following contract to allow duels.
That youkai can easily cause disasters.
That humans can easily resolve disasters.
And the aforementioned
That deciding victors solely based on strength is unacceptable.
That there is nothing superior to elegance and thought.
